D-Link's "Gaming Survey" Giveaway

Official Rules:

No purchase or payment is necessary to enter. Limit one entry per person. All surveys must be submitted to D-Link Systems, Inc. ("D-Link") by 11:59 pm on October 31, 2009 to be eligible. All eligible registrants will be entered to win D-Link's "Gaming Survey" Giveaway (the "Giveaway") in a random drawing. The random drawing will occur 3-5 business days after the close of the Giveaway. Winners will be notified by email within 15 business days and be required to send shipping information in a return email. To receive a list of winners' names, send a self-addressed, stamped envelope to D-Link's "Gaming Survey" Giveaway, 17595 Mt. Herrmann St., Fountain Valley, 92708. The odds of winning depend on the number of eligible entries received and submitted in accordance with the rules. Open to legal residents of the United States, except employees and their immediate families of D-Link and its affiliates, subsidiaries, and advertising and promotion agencies. You must be 18 years of age or older at the time of submission of the survey to win. Winners may be required to submit a signed affidavit certifying their eligibility within 30 days of notification. Failure to submit a properly completed affidavit may result in selection of an alternate winner. All federal, state, and local laws and regulations apply. Void where prohibited or restricted by law. All federal, state, and local taxes are the sole responsibility of the winner. A total of five (5) DGL-4500 Gaming Routers with a retail prize value of $239.99 each will be awarded; a 1099 form will be filed, when applicable, with the IRS in accordance with IRS regulations. By completing and submitting a registration for the Giveaway, the registrant agrees to abide by the terms of these Official Rules and the decisions of D-Link, which are final and binding on all matters pertaining to the Giveaway. All entries become the property of D-Link and will not be returned. D-Link will arrange for delivery of all prizes. Any prize notification or prize that is returned as undeliverable will result in the awarding of that prize to an alternate winner. Except where prohibited by law, each winner consents to the use of their name (with the exception of the winner's contact information, including address, telephone number and email address) in any manner by D-Link and its advertising and promotion agencies without further compensation. D-Link and its affiliates, subsidiaries, divisions, and related companies shall not be responsible for any damages, taxes, or expenses that any winner might incur as a result of the Giveaway or receipt of any prize. All winners accepting prizes agree that all prizes are awarded on the condition that D-Link and its officers, directors, agents, representatives, affiliates, and employees will have no liability whatsoever, and agree to indemnify and hold harmless such parties from any injuries, losses, or damages of any kind resulting from acceptance, possession, or use of the prizes. Each winner further acknowledges that D-Link is not responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition, or fitness. No winner may make any substitutions or transfers of any prize. D-Link reserves the right to substitute cash or a similar prize of equal or greater value. D-LINK, ITS SUBSIDIARIES, AGENTS, AFFILIATES, PARENT, EMPLOYEES, OFFICERS AND/OR DIRECTORS SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTIES FOR ANY DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL, PUNITIVE DAMAGES, OR ANY DAMAGES WHATSOEVER, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, ALLEGEDLY SUSTAINED OR ARISING OUT OF THE GIVEAWAY OR A PRIZE, YOUR USE OF OR RELIANCE ON THE GIVEAWAY OR A PRIZE OR ANY OF THE INFORMATION OR MATERIALS AVAILABLE FROM THE, REGARDLESS OF THE TYPE OF CLAIM OR THE NATURE OF THE CAUSE OF ACTION. THESE LIMITATIONS SHALL APPLY NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY. Entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. Authorized account holder is deemed to be the natural person who is assigned to an email address by an Internet access provider, service provider, or other online organization that is responsible for assigning email addresses for the domain associated with the submitted email address. Each potential winner may be requested to provide D-Link with proof that the potential winner is the authorized account holder of the email address associated with the potentially winning entry. D-Link may cancel or suspend the Giveaway and will have no liability whatsoever if for any reason the Giveaway is not capable of running as planned, including infection, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the reasonable control of D-Link. D-Link reserves the right at its sole discretion to disqualify any individual who corrupts or affects the administration, security, fairness, integrity, or proper conduct of the Giveaway or tampers with the entry process, and to cancel, terminate, modify, or suspend the Giveaway. D-Link assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. D-Link is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any email or entry to be received by D-Link on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to registrants' or any other person's computer related to or resulting from participation or downloading any materials in the Giveaway. CAUTION: ANY ATTEMPT BY AN REGISTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, D-LINK RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH REGISTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.
